Terms and Conditions

(A) Organizer

The organizer of the promotion is Dirk Abrahams GmbH, Collsteder Damm 3, 26340 Zetel-Neuenburg, hereinafter referred to as the “Organizer”.

(B) Scope

These terms and conditions govern participation in the “Try for Free” promotion for Abrahams Toast Salmon and the reimbursement of the purchase price by the Organizer.

Participation requires agreement to these terms and conditions.

(C) Promotional Product

The promotion applies to Abrahams Toast Salmon in the 100g pack size, which is marked with the “Try for Free” promotional sticker and was purchased in food retail in Germany.

(D) Submission Deadline

No fixed calendar purchase end date is planned. The promotion applies to packages with promotional stickers available in stores. The submission deadline runs separately for each eligible purchase.

The proof of purchase, together with the completed participation form, must be submitted by 11:59 PM on the seventh calendar day after the purchase date indicated on the proof of purchase at the latest. The day of purchase is not counted. For example, for a purchase on November 1st, submission is possible until November 8th at 11:59 PM. Local time in Germany applies.

(E) Implementation and Payout

The technical implementation is carried out by Dirk Abrahams GmbH, Collsteder Damm 3, 26340 Neuenburg.

1. ELIGIBLE PERSONS / ELIGIBILITY

1.1 Eligible participants are natural persons who are at least 18 years old at the time of purchase and reside in Germany.

1.2 Each person may participate in the promotion once. In addition, participation is limited to one reimbursement per household. A household is defined as persons who live and manage their finances together.

1.3 For participation, the required information must be complete and truthful.

1.4 Employees of Dirk Abrahams GmbH and its affiliated companies within the meaning of Section 15 of the German Stock Corporation Act (AktG), as well as their relatives, are excluded from participation.

1.5 Participation via sweepstakes clubs, participation agencies, or automated services is excluded.

2. REGISTRATION FOR PARTICIPATION

2.1 Participation takes place at www.abrahams-aktion.de by completing the participation form, uploading the proof of purchase, and uploading a photo of the back of the product packaging within the submission deadline specified under (D).

2.2 For participation, the first and last name, residential address, email address, age, as well as the name of the account holder and the IBAN of the bank account designated for reimbursement, must be provided.

2.3 The photo of the back of the product packaging and the uploaded proof of purchase must be clearly recognizable and legible. The proof of purchase must show the retailer, the date and time of purchase, the promotional product, the purchase price paid for it, and the existing receipt or transaction number. Unnecessary information about other purchases may be blacked out, provided that the review of the promotional purchase is not impaired thereby.

2.4 Each proof of purchase may only be used once for this promotion. If multiple packages are listed on one proof of purchase, the purchase price for one package will be reimbursed. The limitation to one reimbursement per person and household remains unaffected.

2.5 Please keep the original proof of purchase and the promotional sticker until the reimbursement is completed. If there are justified ambiguities, the Organizer may request supplementary proof, in particular a photo of the packaging with the promotional sticker.

2.6 The transfer of proofs of purchase to other persons or via participation and sweepstakes portals with the aim of an unauthorized or multiple reimbursement is not permitted.

3. PROCESS OF THE “TRY FOR FREE” PROMOTION

3.1 Participation is exclusively for the promotional product mentioned under (C). The submission deadline and the method of participation are set out in (D) and Section 2.

3.2 If these terms and conditions are met, the actual purchase price for one package will be reimbursed. Price reductions applicable to the promotional product will be taken into account for reimbursement. Further shopping, travel, or other costs will not be reimbursed.

3.3 After submitting the participation form and proof of purchase, the participant will receive a confirmation of receipt by email. This only confirms the receipt of the submitted data and does not yet constitute confirmation of a claim for reimbursement.

Subsequently, the information and the proof of purchase will be reviewed. A separate email regarding the start or successful completion of the review will not be sent. The regulations regarding inquiries and corrections according to Section 3.4 and the notification of a rejection according to Section 5.3 remain unaffected. The deadline for payout is governed by Section 4.1.

3.4 In the case of illegible documents or correctable information, the participant will be contacted via the email address provided and given the opportunity to supplement or correct the information within 5 days of receiving the message.

3.5 A timely received participation will continue to be processed even if no new promotional packages are being delivered in the meantime.

4. PAYOUT AND FORFEITURE

4.1 If the participation conditions are met, reimbursement will be made by bank transfer within 21 days of receipt of the complete and verifiable documents.

4.2 The payout will be made by Dirk Abrahams GmbH to the bank account specified in the participation form. The payout will be made in Euros to a payment account reachable for SEPA transfers within the European Union.

4.3 Faulty, incorrect, incomplete, and/or illegible receipts will not be approved. The participant will be contacted via the email address provided and given the opportunity to supplement or correct the information within 5 days of receiving the message.

5. EXCLUSION OF PARTICIPANTS / EARLY TERMINATION OF THE PROMOTION

5.1 No claim for reimbursement exists in case of late submission, already reimbursed purchases, exceeding the participation limit, or forged or fraudulently altered proofs of purchase. Also excluded are participations where no payment account reachable for SEPA transfers within the European Union is provided. Likewise excluded are purchases that have been reversed and whose purchase price has already been refunded.

5.2 Additionally, persons who attempt to obtain an unauthorized reimbursement through intentionally false information or by manipulating the participation form, the promotion website, or the verification process may be excluded from participation.

5.3 If a reimbursement is rejected, the participant will be informed of the reason via the email address provided.

5.4 The Organizer reserves the right to interrupt, adapt to the necessary extent, or prematurely terminate the “Try for Free” promotion for objectively justified reasons if unforeseeable circumstances for which the Organizer is not responsible significantly impair or make proper execution impossible.

Such circumstances may include, in particular, significant disruptions due to malware, serious failures of the hardware or software used, or compelling legal obstacles. A higher than expected number of participants, redemption rate, or cost burden alone does not constitute such a reason.

The Organizer will assess, with due consideration of the interests of the participants, whether the promotion can be continued and whether a temporary interruption or adaptation is sufficient compared to a termination. A measure without prior announcement will only be taken if immediate action is required.

The Organizer will promptly inform about an interruption, significant adaptation, or premature termination on www.abrahams-aktion.de.

Already established claims for reimbursement remain unaffected. The legitimate interests of persons who have already purchased a promotional package in reliance on the advertised reimbursement will be protected. In the event of a technical unavailability of the participation form for which the Organizer is responsible, a suitable alternative submission option or a corresponding extension of the deadline will be provided.

6. LIABILITY

The Organizer is liable according to statutory provisions.

7. DISPUTE RESOLUTION PROCEDURE

The Organizer is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
